Terms of Donation and Participation
1. General Information
These terms and conditions regulate donations, collaborations, contributions, registrations, solidarity campaigns, and other forms of participation carried out through the FERO Foundation website and the digital channels enabled by the entity.

Hereinafter, FERO Foundation or FERO.
2. Purpose
FERO Foundation aims to promote, boost, and support oncology research, facilitating the funding of scientific projects, scholarships, programs, outreach activities, and actions linked to its foundational purposes.
Through the website, users can collaborate with FERO through one-time donations, recurring donations, participation in solidarity campaigns, registration for activities, or any other modality enabled at any given time.
3. Acceptance of Terms and Conditions
Making a donation, registration, or participation through the website implies acceptance of these terms and conditions, as well as the Privacy Policy, the Cookie Policy, and any specific conditions that may apply to a particular campaign, event, call, or form.
When there is a specific condition applicable to a particular activity, it shall prevail over these terms and conditions in anything that is incompatible.
4. Donations
Donations made to FERO Foundation are voluntary and will be used to fulfill its foundational purposes.
The donor may choose, when the form allows, the donation amount, frequency, target project or campaign, and the necessary data to process it.
FERO Foundation may use the funds received according to the purpose indicated in the campaign or, when there is no specific purpose, according to the priorities and needs linked to its foundational objectives.
5. One-Time Donations
One-time donations are charged only once using the payment method selected by the donor.
Before confirming the operation, the user must review the amount, their data, and the chosen payment method.
Once the donation is confirmed, the system may issue an automatic confirmation or send a receipt to the provided email address, without prejudice to the subsequent issuance of the tax certificate when applicable.
6. Recurring Donations
When the website allows for setting up recurring donations, the donor authorizes FERO Foundation, or the corresponding payment provider, to make recurring charges according to the selected frequency.
The donor may request the modification or cancellation of their recurring donation by writing to fero@ferocancer.org.
The cancellation will affect future charges, without affecting contributions already correctly made previously.
FERO Foundation may contact the donor to verify the modification or cancellation request and prevent errors or fraudulent actions.
7. Payment Methods
Donations, registrations, or contributions may be made using the payment methods enabled at any given time, such as bank card, direct debit, bank transfer, payment gateway, external platforms, or any other available system.
Payments may be managed by financial entities, technological providers, or external payment platforms, which will apply their own terms of use, privacy, and security.
FERO Foundation will not necessarily access complete bank card data or other payment methods, which may be processed directly by the corresponding payment provider.
8. Operation Confirmation
After completing a donation, registration, or contribution, the user may receive a confirmation on screen or by email.
The confirmation of the operation does not necessarily imply the immediate issuance of the tax certificate or the definitive validation of all provided data.
When errors, incomplete data, duplicate operations, technical incidents, or indications of fraud are detected, FERO Foundation may contact the user to verify the information or take appropriate measures.
9. Errors, Duplicates, and Refunds
Donations are voluntary contributions intended for FERO’s foundational purposes.
However, the donor may request a review of an operation when a material error, duplication, incorrect amount, unauthorized charge, or technical incident has occurred in the payment process.
These requests must be communicated to fero@ferocancer.org, indicating the necessary data to identify the operation.
FERO Foundation will analyze each case and, when appropriate, manage the total or partial refund of the amount by the same payment method used or by another reasonable system.
A subsequent decision not to collaborate will not be considered an error, unless applicable regulations or the specific conditions of a campaign state otherwise.
10. Tax Certificates
Donors may request or receive, when applicable, the tax certificate corresponding to their donations.
To issue it correctly, FERO Foundation may request the necessary identification and tax data, such as full name, Tax ID (NIF) or equivalent document, tax address, donated amount, and other information required by applicable regulations.
The application of possible tax benefits will depend on current regulations, the personal or tax situation of each donor, and compliance with legally established requirements.
The donor is responsible for providing truthful, accurate, complete, and updated data for the correct issuance of the certificate.
11. Identification Obligations
FERO Foundation may request additional information to identify the donor when necessary for tax, accounting, administrative, fraud prevention, or compliance with anti-money laundering and terrorist financing regulations.
In particular, it may be necessary to identify and verify the identity of individuals who make gratuitous contributions equal to or greater than the legally established threshold.
Failure to provide the necessary information may prevent the processing of the donation, the issuance of the tax certificate, or the definitive acceptance of the contribution.
12. Solidarity Campaigns
FERO Foundation may enable solidarity campaigns, challenges, forms, or specific pages to raise funds linked to specific projects, events, or initiatives.
Anyone participating in a campaign must use it lawfully, respectfully, and consistently with the purposes of FERO Foundation.
It is not permitted to use campaigns to disseminate illicit, offensive, discriminatory, misleading, advertising, fraudulent content, or content contrary to the rights of third parties.
FERO Foundation may review, suspend, modify, or withdraw campaigns, messages, or content when it considers that they violate these terms and conditions, affect the entity’s image, or may generate legal liabilities.
13. Events, Activities, and Registrations
When FERO Foundation organizes events, galas, activities, meetings, conferences, or initiatives requiring registration, specific conditions may apply regarding available places, participation fees, payment methods, cancellations, date changes, access, accreditations, or attendance rules.
Registration will be subject to availability, compliance with the indicated requirements, and the correct receipt of corresponding data and payments.
FERO Foundation may modify or cancel an activity for organizational, technical, health, safety, force majeure, or any other justified reason.
In case of cancellation or significant modification, FERO will inform registered individuals using the contact details provided.
14. Participation of Minors
The participation of minors in donations, campaigns, events, or activities must be carried out with the authorization of their parents, guardians, or legal representatives when necessary.
FERO Foundation may request additional documentation or authorization to verify legal representation or the corresponding authorization.
15. Use of Image in Events and Activities
During some events or activities organized by FERO Foundation, photographs, videos, or recordings may be taken for informational, documentary, outreach, or institutional communication purposes.
When necessary, attendees will be informed in advance or the corresponding authorization will be requested.
Individuals who do not wish to appear in identifiable images may communicate this to the organization, without prejudice to reasonable limitations in public acts or open spaces.
16. Communications Related to Collaboration
FERO Foundation may use the data provided to send necessary communications related to the donation, registration, campaign, tax certificate, modification, cancellation, or any other management linked to the user’s participation.
Informational, promotional communications, newsletters, or fundraising campaigns by electronic means will be sent in accordance with the Privacy Policy and only when there is a valid legal basis.
The user may unsubscribe from non-essential communications at any time.
17. Personal Data Protection
Personal data provided through donation, registration, participation, or collaboration forms will be processed in accordance with FERO Foundation’s Privacy Policy.
This policy provides information on the data controller, purposes, legal bases, recipients, retention periods, and the rights of data subjects.
18. Security and Fraud Prevention
FERO Foundation may adopt technical, organizational, and verification measures to protect the security of operations carried out through the website and prevent misuse, impersonation, fraudulent operations, or unauthorized access.
When there are indications of fraud, error, abusive use, or non-compliance with these terms and conditions, FERO may temporarily suspend the operation, request additional information, reject a contribution, or report the facts to the competent authorities when appropriate.
19. User Responsibility
The user undertakes to provide truthful, accurate, complete, and updated information.
They also undertake to use the website, forms, campaigns, and payment systems lawfully, diligently, and in accordance with these terms and conditions.
The user will be responsible for any damages, losses, or liabilities that may arise from the provision of false data, fraudulent use of payment methods, or non-compliance with these terms and conditions.
20. Modification of Terms and Conditions
FERO Foundation may modify these terms and conditions to adapt them to regulatory, technical, organizational changes, or those related to its activities, campaigns, forms, or collaboration systems.
The current version will be the one published on the website at any given time.
Modifications will not affect operations already confirmed, unless they are necessary due to a legal obligation or for justified reasons.
21. Applicable Law and Jurisdiction
These terms and conditions are governed by Spanish law.
Any dispute related to donations, registrations, campaigns, or participations carried out through the website will be submitted to the competent courts and tribunals in accordance with applicable regulations.
Where there is no mandatory rule determining another jurisdiction, the parties will submit to the courts and tribunals of Barcelona.
